Eight siblings were arguing about how to divide the inheritances of their parents. Among the issues that reached the Supreme Court (TS) were some outstanding amounts to be paid among them, the community expenses of some homes, and the money that the parents had given to two of their children to buy other properties. The TS partially agrees with the siblings who had filed the lawsuit, although it does not accept all their requests.

One of the discussions was whether community expenses could be deducted from what was owed to two siblings. The TS says no in the case of the examined expenses since they were incurred before the homes were allocated to them. Having received the apartments later is not enough to assume that they had to pay those bills. It was also not proven that, during that period, they used or enjoyed the homes. Therefore, the TS eliminates the compensation referred to in the ruling. The decision affects that specific item, not all the compensations discussed in the lawsuit.

The other important issue relates to two homes and their parking spaces . The TS maintains that what their parents donated to them was the money to buy them, not the homes; these had never belonged to the parents. This money must be taken into account when completing the distribution of the inheritances. Its updated value will be calculated when that additional partition is made, and not by referencing the previous partitions.

The TS also recognizes the interests that the siblings had agreed upon for the outstanding amounts to be paid. If they do not reach an agreement on the calculation, they will be settled upon executing the sentence. In addition, it sets legal interests for the delay from the filing of the claim and those anticipated after the first instance ruling.
